GENERAL TERMS AND CONDITIONS FOR REGISTRATION TO THE TIM ENTERPRISE CUSTOMER AREA
Subject and Applicable Regulations
These General Terms and Conditions define the terms and conditions under which Telecom Italia S.p.A. ("Telecom Italia" or "TIM") provides the Customer with online services via the TIM Enterprise site, particularly through the Business Customer Area (hereinafter the "Service"), including: viewing the profile and details of the Customer’s TIM fixed and/or mobile lines; viewing invoices issued over recent periods and full traffic documentation for the last few months, with the final three digits masked; viewing the processing status of requests made to Customer Service in recent months; consulting standard post-billing reports regarding voice and data service consumption, and creating customized reports upon subscription to specific offers providing such services; access to specific features potentially made available within the Customer's activated services; the ability to purchase TIM products/services online, with payment upon delivery, by credit card, or via TIM invoice where available. The availability of some features depends on the profile assigned to the Customer at the time of registration. For example, some features are exclusively reserved for the Legal Representative of the Company or a delegated representative. All services and their descriptions can be consulted in the appropriate Support and Business Customer Area sections of the TIM Enterprise website https://www.areaclienti.timenterprise.it/
The contractual relationship between TIM and the Customer (the "Contract") is governed by these General Terms and Conditions.
TIM reserves the right to modify the Service, including the gradual introduction of new online services over time.
Formation of the Contract
The Contract is considered finalized when the Service is activated by TIM following the Customer’s registration.
Upon activation of the account, TIM will send a confirmation email to the address provided during registration.
Customer Data
To use the Service, the Customer must provide TIM with their personal data — in particular, a valid email address — truthfully, accurately, and completely, taking responsibility for any damage resulting from inaccuracies. The Customer is liable for any damage caused to TIM and/or third parties due to inaccurate data and undertakes to indemnify TIM from any third-party claims.
TIM reserves the right to refuse, suspend, or terminate the Service at any time should the data provided by the Customer prove incorrect or incomplete.
Conditions for Using and Accessing the Service. Confidentiality and Diligence Obligations
The use of the Service requires that the Customer has the necessary hardware and software devices for its operation. Lack of such requirements results in the inability to use the Service, with no responsibility attributed to TIM.
Access to the Service is granted through a customer identification code (Username) and a password ("Access Credentials").
The Customer must keep the Access Credentials, particularly the password, strictly confidential and exercise the utmost diligence.
The Customer must immediately notify TIM in writing of any theft, loss, or unauthorized use of their Access Credentials. The Customer is responsible for any damage to TIM and/or third parties resulting from non-compliance and agrees to indemnify TIM from any third-party claims. TIM may suspend the Service without notice if these obligations and prohibitions are violated.
The Service is provided free of charge to Customers who agree to these Terms and Conditions.
Registered Customers requesting to receive TIM invoices exclusively in electronic format will receive periodic notifications regarding invoice availability in the Customer Area, sent to the email address provided during registration. Electronic invoice requests are available only upon activation of direct debit payment through a bank or postal account.
The Customer acknowledges that TIM will send communications regarding the Service to the email address and/or mobile phone number provided during registration or to the designated communication email address.
TIM provides access to the Service 24/7.
Operational Log
The Customer acknowledges and accepts the existence of an operational electronic log ("Log") maintained by TIM. The Log is strictly confidential and will only be disclosed upon request from competent authorities.
The Customer agrees to refrain from any network and system security violations that could incur civil or criminal liability, including but not limited to:
a) unauthorized access to third-party systems, networks, or information;
b) interception of third-party data or network traffic without authorization;
c) identity falsification;
d) unauthorized access, destruction, or alteration of third-party customer information;
e) network/system attacks (mailbombing, broadcast attacks, Denial of Service, Hacking, Cracking);
f) use of third-party mail servers for mail relay without authorization;
g) sending malicious programs (viruses, trojans, etc.) that compromise network/system security;
h) sending unsolicited emails ("spam") or mass emails to newsgroups.
TIM reserves the right, without prior notice, to remove Customer material or suspend/cancel the Customer's account if any of the above obligations are violated or if TIM receives credible reports of such violations.
The Customer acknowledges that all software ("Software") provided for Service use contains confidential information protected by intellectual property laws. Except as expressly authorized by TIM, the Customer may not modify, distribute, create derivative works, sublicense, rent, sell, reverse engineer, disassemble, decompile, translate, or attempt to extract source code from the Software.
The Customer must comply with all TIM instructions for proper Service use.
In case of any violation, the Customer agrees to indemnify TIM against all damages, liabilities, costs, and expenses, including legal fees, arising from the violation or misuse of the Service.
Disclaimer of TIM's Liability. Service Interruption
TIM shall not be held responsible — neither to the Customer nor to any related parties — for delays, malfunctioning, suspension, or interruption of the Service caused by:
force majeure or unforeseen events;
unauthorized tampering by the Customer or third parties;
failure by the Customer to comply with Service access conditions;
incorrect use of online services by the Customer;
hardware or software malfunction;
internet connectivity issues unrelated to TIM.
The Customer accepts that TIM may, without liability for compensation, temporarily suspend the Service to perform necessary maintenance, notifying the Customer online or via the registered email address. TIM is also not responsible for any lack of availability caused by third-party internet providers.
Customer Support
The Customer Support Service is available 24/7 by calling 800.191.101.
Changes to the Terms and Conditions
TIM will inform Customers of any changes to these General Terms and Conditions. Changes will become effective no sooner than 30 (thirty) days from notification. Customers who do not accept the changes may withdraw from the Contract without penalties by contacting Customer Service before the effective date of the changes. Failure to exercise the withdrawal right implies acceptance of the changes.
The Customer may request account cancellation by calling 800.191.101. Customers who receive invoices solely online must request reactivation of paper invoices, which are subject to shipping fees charged to their TIM invoice.
Duration. Account Functionality Limitation. Termination. Withdrawal
The Service is provided indefinitely, starting from the activation date.
The Customer may withdraw at any time by contacting Customer Service at 800.191.101. The withdrawal will take effect upon registration by TIM's systems, and no later than 30 days from the communication date.
Termination for Breach. Service Suspension
TIM may terminate the Contract automatically, pursuant to Art. 1456 of the Italian Civil Code, by written notice in case of breach of obligations under the following articles:
Art. 3 ("Customer Data"); Art. 4 ("Service Conditions and Access. Confidentiality and Diligence Obligations"); Art. 6 ("Service Use, Responsibility, and Guarantees").
TIM also reserves the right to suspend the Service immediately, without notice, for any breach of these articles.
Governing Law. Jurisdiction
The Contract is governed by Italian law.
Any dispute arising from the Contract will fall under the jurisdiction of the court where the Customer resides or is domiciled.
Communications and Privacy
Communications and personal data processing are carried out in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation - GDPR). Customer data provided for registration and/or transactions will be processed solely for necessary purposes in compliance with GDPR, Legislative Decree 196/2003 as amended by Legislative Decree 101/2018, and other applicable laws. Processing is conducted securely and confidentially, as specified in the privacy policy available on the TIM Business website or via this link.
